Welcome to SparkUpBiz.com, an online professional networking community operated by SparkUp Biz Inc.
By accessing or using the SparkUpBiz platform, including Fire Circle Referral Groups, you agree to comply with these Terms and Conditions, our Privacy Policy, and any additional policies posted on the platform.
These Terms are designed to maintain a professional, respectful, and productive networking environment for all members.
1. Acceptance of Terms
By registering for and using the SparkUpBiz platform, you agree to be bound by these Terms and Conditions, our Privacy Policy, and any policies or guidelines published on the platform.
If you do not agree to these Terms, you must not access or use the platform.
2. Eligibility
To use SparkUpBiz.com, you must:
Be at least eighteen (18) years old, or the age of majority in your jurisdiction
Be capable of entering legally binding agreements
Provide accurate registration information
By registering, you represent and warrant that you meet these eligibility requirements.
3. Community Conduct
SparkUpBiz is committed to maintaining the highest standards of conduct within the community.
Members must:
Respect and Inclusivity
Treat all members with respect regardless of race, ethnicity, gender, sexual orientation, religion, or other protected characteristics.
Professionalism
Engage in professional and courteous behavior at all times. Personal attacks, harassment, threats, or abusive language will not be tolerated.
Content Standards
Content shared on the platform must be appropriate for a professional networking environment.
Privacy
Members must respect the privacy of other members and may not share personal information without consent.
Anti-SPAM Policy
Members may not send unsolicited mass messages or promotional outreach.
Violations will result in:
First violation: Warning
Second violation: Warning
Third violation: Permanent removal without refund
4. Prohibited Content
The following content is strictly prohibited:
Sexual Content
Any sexually explicit or sexually suggestive material.
Illicit Content
Content related to illegal activities, including illegal drug use, violence, or criminal behavior.
Political Content
Promotion of political parties, candidates, or politically charged messaging.
Derogatory Content
Content that demeans or attacks individuals or groups based on protected characteristics.
Hate Speech or Religious Attacks
Any content that promotes hate speech or attacks religious beliefs.
Misleading Claims
Members must not make false, misleading, or unsubstantiated claims, including medical, health, or financial claims.
5. Content Responsibility
Members are solely responsible for any content they post or share.
SparkUpBiz.com:
Does not endorse third-party content
Is not responsible for member-generated content
May remove content that violates these Terms
Members agree that all content posted must comply with:
Applicable laws and regulations
Professional and ethical standards
6. Monitoring and Enforcement
SparkUpBiz reserves the right to:
Monitor content and activity on the platform
Remove content that violates these Terms
Suspend or terminate accounts that violate policies
Report illegal activity to law enforcement
Accounts may be terminated without notice and without refund if members engage in disruptive or harmful behavior.
7. Fire Circle Referral Groups
Fire Circles are specialized referral networking groups within the SparkUpBiz community.
Participation in a Fire Circle is subject to all SparkUpBiz platform Terms, plus the additional provisions below.
7.1 Fire Circle Eligibility
Fire Circle members must:
Maintain an active SparkUpBiz paid membership
Be a member in good standing
Be capable of entering legally binding agreements
Be at least eighteen (18) years old
7.2 One Member Per Classification
To maintain fairness and referral integrity:
Only one active member per professional classification is allowed in each Fire Circle.
SparkUpBiz reserves the right to determine classification eligibility.
7.3 Participation Expectations
Members are expected to actively participate in their Fire Circle.
Members should:
Attend meetings consistently
Remain present for the full meeting
Participate respectfully
Provide referrals when reasonably possible
Members who miss more than six (6) meetings per year or fail to participate may be removed from the group.
7.4 Professional Conduct in Fire Circles
All Fire Circle interactions must follow SparkUpBiz conduct policies, including:
Professional behavior
Respectful communication
No harassment or discrimination
Compliance with anti-SPAM rules
This applies to:
Meetings
Chat communications
Direct messages
Referral exchanges
Platform interactions
7.5 Use of Member Information
Member contact information obtained through Fire Circles may only be used for:
Legitimate referral networking
Group communications
Members may not:
Add other members to marketing lists without consent
Share contact information outside the group without permission
8. Fees and Billing
Participation in Fire Circles requires:
An active SparkUpBiz membership
A Fire Circle subscription add-on
If a member does not have an active SparkUpBiz membership, a bundled membership and Fire Circle subscription may be offered at $30 per month.
Members will not be billed or placed into a group until a minimum of ten (10) members are confirmed.
Invoices will only be issued after written acceptance of group placement.
Members may cancel their subscription at any time by emailing:

9. Fire Circle Leader Program
Approved Fire Circle leaders receive a 20% membership discount applied to their SparkUpBiz membership and Fire Circle subscription.

10. Referral Invitation Discount
Members who invite new participants to their Fire Circle may receive a 10% membership discount for one (1) year per successful referral.
Maximum discount: 20% per year
If the inviting member is an Affiliate Partner, their maximum affiliate commission for that member will be 20% residual.
11. Intellectual Property
Members retain ownership of content they post.
However, by posting content on the platform, members grant SparkUpBiz a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the platform.
All SparkUpBiz branding, software, and materials remain the property of SparkUp Biz Inc.
12. Privacy and Data Security
SparkUpBiz respects member privacy and does not sell user information.
We collect and use information to:
Operate the platform
Facilitate networking
Improve services
Maintain community safety
While we use reasonable security measures, we cannot guarantee absolute protection against unauthorized access.
13. Disclaimer of Warranties
The SparkUpBiz platform is provided “as is” and “as available.”
SparkUpBiz makes no warranties regarding:
Platform availability
Accuracy of information
Reliability of services
14. Limitation of Liability
To the fullest extent permitted by law, SparkUpBiz shall not be liable for:
Loss of profits
Loss of data
Loss of business opportunities
Any indirect or consequential damages
arising from use of the platform.
15. Indemnification
Members agree to indemnify and hold SparkUpBiz harmless from any claims, damages, losses, or legal expenses arising from:
Violation of these Terms
Misuse of the platform
Content posted by the member
16. Termination
SparkUpBiz reserves the right to suspend or terminate any account at its discretion if a member violates these Terms or disrupts the community.
Termination may occur without refund.
17. Governing Law
These Terms are governed by the laws of the State of New York.
Any disputes will be resolved in the courts located in Fulton County, New York.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
19. Changes to Terms
SparkUpBiz may update these Terms at any time.
Continued use of the platform constitutes acceptance of the updated Terms.
20. Academy Course Disclaimer
Educational materials provided through SparkUpBiz Academy are for informational purposes only and do not constitute professional advice.
SparkUpBiz is not responsible for actions taken based on course material.
All content is provided “as is” without warranties of any kind.
