$5k for 5k Giveaway – Terms and Conditions

  1. Eligibility: 
  • The giveaway is open to individuals who are legal residents of the United States and Canada and have reached the age of majority in their state, province, or country of residence as of the date of entry. 
  • Employees, officers, directors, agents, and representatives of SparkUp Biz Inc, including their immediate family members (spouse, parents, siblings, and children) and household members, are not eligible to participate or win. 
  • The subscriber is only eligible with one account.  
  • No purchase is necessary to enter or win.  A free membership to SparkUpbiz.com is sufficient for eligibility. 
  • No use of bots, AI, or other rigging system to subscribe are allowed. 
  1. Entry Period: 
  • The entry period of the giveaway begins on 08/01/2024 and ends when the 5,000th paid subscriber’s transaction is completed.  
  1. How to Enter: 
  • To enter the giveaway, individuals must subscribe to SparkUp Biz Inc’s  
  • Optionally, refer new subscribers through the affiliate program to increase their chances of winning. 
  • The giveaway is automatically open to the 5,000th paying subscriber. 
  • Upgrades to current paid subscriptions are also eligible for the giveaway. 
  1. Prize: 
  • Three prizes of $5,000 each will be awarded when the 5,000th paid subscription is completed. 
  • $5,000 to one randomly selected subscriber. 
  • $5,000 to the Affiliate Partner who referred the winning subscriber. 
  • $5,0000 to the Affiliate Partner who referred the most paid subscribers at the time of awarding. 
  • Prizes are payable in US Dollars.  All taxes are the responsibility of the recipient. 
  • The prize is non-transferable and no substitution will be made except as provided herein at SparkUp Biz Inc’s sole discretion. 
  • If no Affiliate Partner is responsible for bringing in the 5,000th paid subscriber, the award will be deferred to SparkUp Biz Inc. 
  1. Winner Selection: 
  • Winners will be selected in a random drawing from all eligible entries received during the Entry Period.  
  • The drawing will be conducted  by Sparkup Biz or its designated representatives, whose decisions are final and binding.  
  • Winners will be notified via email within 1 business days of the drawing. Winners must respond within 7 business days to claim their prize.  
  • If a potential winner cannot be contacted, fails to respond within the required time period, or is disqualified for any reason, an alternate winner may be selected. 
  1. Publicity: 
  • By participating in the giveaway, each entrant grants SparkUp Biz Inc the right to use the entrant’s name, voice, likeness, and biographical information for promotional purposes in any media without further payment or consideration, unless prohibited by law. 
  1. Privacy: 
  • All personal information collected by SparkUp Biz Inc will be used for the administration of the giveaway and in accordance with SparkUp Biz Inc’s privacy policy. 
  1. General Conditions: 
  • SparkUp Biz Inc reserves the right to cancel, suspend, and/or modify the giveaway, or any part of it, if any fraud, technical failures, or any other factor beyond SparkUp Biz Inc’s reasonable control impairs the integrity or proper functioning of the giveaway, as determined by SparkUp Biz Inc in its sole discretion. 
  • SparkUp Biz Inc reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the giveaway or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner. 
  • Any attempt by any person to deliberately undermine the legitimate operation of the giveaway may be a violation of criminal and civil law, and, should such an attempt be made, SparkUp Biz Inc reserves the right to seek damages from any such person to the fullest extent permitted by law. 
  1. Release and Limitation of Liability: 
  • By participating in the giveaway, entrants agree to release and hold harmless SparkUp Biz Inc and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the giveaway or receipt or use or misuse of any prize. 
  1. Disputes: 
  • Except where prohibited, entrants agree that any and all disputes, claims, and causes of action arising out of, or connected with, the giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Fulton County, New York. 
  • All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, entrants’ rights and obligations, or the rights and obligations of SparkUp Biz Inc in connection with the giveaway, shall be governed by, and construed in accordance with, the laws of Fulton County, New York, without giving effect to any choice of law or conflict of law rules.

  • The sponsor of the giveaway is SparkUp Biz Inc, located in Fulton County, NY 
  1. Winners List: 
  • To request the name of the winner, email info@sparkupbiz.com. Requests must be received within four (4) weeks after the end of the Entry Period.
